According to ABC 8 (TABC probe finds club promoted excessive drinking prior to deadly Josh Brent crash,” August 2), the Texas Alcoholic Beverage Commission (TABC) found substantial evidence that a Dallas nightclub served alcohol to visibly intoxicated customers and might have even encouraged “excessive” drinking the night of a deadly drunk driving car accident that claimed the life of a Dallas Cowboys football player.

“Under Texas Dram Shop laws, bars and restaurants have a legal responsibility to exercise good judgment in serving patrons alcoholic beverages,” said Carse, who represents victims of negligence and families who lost loved ones in accidents. “If a visibly intoxicated patron is served or encouraged to drink more alcohol, and this patron then causes a serious drunk driving accident, the bar or restaurant could be held liable for their actions.”

The article stated that in the early morning of December 8, 2012, the Dallas nightclub served members of the Dallas Cowboys football team excessive amounts of alcohol just hours before a drunk driving accident claimed the life of Cowboys player Jerry Brown Jr. According to a court affidavit (Dallas County Court, case number: 120028613), the driver is facing vehicular manslaughter charges in connection with the crash.

ABC 8 reported that the TABC will not file formal charges until the conclusion of the related manslaughter trial against the Cowboys teammate behind the wheel at the time of the crash. If charges are brought forth against the nightclub, it could face a fine or have its license to operate suspended or revoked, according to the article.

“As we’ve seen in this tragic accident that resulted in the loss of a promising young football player, drunk driving cannot be tolerated, period. While it’s crucial to choose a designated driver and to act responsibly while at a bar or restaurant, it’s also the legal obligation of the bar or restaurant staff to exercise good judgment in serving alcohol to their patrons,” said Carse, a car accident lawyer in Dallas. “In Texas, dram shop liability laws designate that legal action can be taken against a bar or restaurant if they’ve served alcohol to a visibly intoxicated patron who leaves their establishment and causes a car crash.”
